Party Wall Surveyors in Leicestershire and Rutland acting for the Building Owners undertaking building works, the Adjoining Owners affected by the works or as an Agreed Surveyor for both Owners.

The Party Wall etc Act 1996 is intended to provide protection to a Building Owner who wishes to carry out alterations to their property and their neighbour(s) who may be affected by the works.

The intention of the Act is to ensure that the building works can be undertaken in a reasonable manner and that the Adjoining property is protected against any damage or repaired if damage occurs.

Party Wall etc. Act 1996

The Party Wall etc. Act relates to building works affecting a neighbouring property.  This legislation most commonly applies to a shared ‘party wall’, such as that between two semi-detached houses, where it is intended to do works to this wall such as insert a steel beam.  The Act also affects nearby properties where the proposed foundations, or adjacent excavations for drains, may be at a lower level than the existing foundations to another building.  The provisions of the Act will also apply where it is intended to build up to the boundary where there was not a wall or building previously.

Any surveyor appointed under the terms of the Act is obliged to act impartially and without bias to either the Building Owner or the Adjoining Owner(s).  

On behalf of the Building Owner we can issue the relevant notices under the Act.  Where a dispute arises we would normally prepare or agree a written and photographic Schedule of Condition of the adjoining  building(s) and would negotiate and agree a Party Wall Award between the Owners.

On completion of the works we would re-inspect the property(ies) to assess whether any damage has been cause.

Current Instructions

Following receipt of notices under the Party Wall etc. Act 1996 we were appointed as the Adjoining Owners Surveyor to prepare a schedule of condition and agree an Award under the Act.

We were appointed by the owners of this property adjoining the proposed building works in March 2019 to act as their surveyor under the Party Wall etc. Act 1996 following recepit of notices served by the Building Owner intending to alter and extend their property.
